{"id":7538,"date":"2016-08-24T23:17:01","date_gmt":"2016-08-25T04:17:01","guid":{"rendered":"https:\/\/phrdev.pixelpro.website\/novedades\/dian-revenue-ruling-88\/"},"modified":"2021-05-07T11:53:49","modified_gmt":"2021-05-07T16:53:49","slug":"dian-revenue-ruling-88","status":"publish","type":"post","link":"https:\/\/phrlegal.com\/en\/legal-bulletin\/dian-revenue-ruling-88\/","title":{"rendered":"DIAN REVENUE RULING"},"content":{"rendered":"<p><strong>DIAN REVENUE RULING<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>An investment in Non-Conventional Energy Sources made through a financial lease, cannot receive the tax benefits of Law 1715 of 2014 if the lease agreement was signed prior to the enactment of said law<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Under this assumption, the requirements to acquire the tax benefit recognized in Article 11 of Law 1715 of 2014 are not met<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p style=\"text-align: justify;\">Through its Revenue Ruling No. 14749 of June 13<sup>th <\/sup> 2016, the Colombian Tax Authority\u2014DIAN- refers to the case in which investments in Non-Conventional Energy Sources (FNCE) made using financial lease agreements occur based on an agreement signed prior to the entry into force of Law 1715 of 2014.<\/p>\n<p style=\"text-align: justify;\">DIAN considers that a financial lease agreement signed before the entry into force of Law 1715 of 2014 does not meet the requirement of being a new investment in FNCE.
