{"id":8483,"date":"2016-05-20T15:32:30","date_gmt":"2016-05-20T20:32:30","guid":{"rendered":"https:\/\/phrdev.pixelpro.website\/novedades-categoria\/colombia-63\/"},"modified":"2020-10-28T10:10:31","modified_gmt":"2020-10-28T15:10:31","slug":"colombia-63","status":"publish","type":"post","link":"https:\/\/phrlegal.com\/en\/legal-bulletin\/colombia-63\/","title":{"rendered":"COLOMBIA"},"content":{"rendered":"<p><strong>COLOMBIA <\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>LA PR\u00c1CTICA DE LA OFICINA DE PATENTES COLOMBIANA PARA LAS MODIFICACIONES, DIVISIONALES, CONVERSIONES DE SOLICITUDES Y FUSIONES<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Mediante la Resoluci\u00f3n 3719 de 2 de febrero de 2016, la Oficina de Patentes colombiana implement\u00f3 una serie de medidas relacionadas con la forma en la que se puede dividir la materia de las solicitudes divisionales, el momento en el que se puede hacer, y otros aspectos sobre las modificaciones.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p style=\"text-align: justify;\">Se pueden presentar solicitudes divisionales hasta antes de que se profiera una decisi\u00f3n final, esto es hasta antes de la resoluci\u00f3n que decide el recurso.  Se entiende que inclusive con el recurso se puede presentar una divisional.  Ahora bien, si hay un examen de fondo y como respuesta al mismo el cliente cancela reivindicaciones, podr\u00e1 reservarse el derecho de presentar una divisional m\u00e1s adelante de estas reivindicaciones, siempre y cuando est\u00e9 sustentada esa materia en la descripci\u00f3n.<\/p>\n<p style=\"text-align: justify;\">No se pueden presentar solicitudes divisionales de solicitudes inicialmente fraccionadas.  Si se desea presentar una divisional o se quiere hacer una modificaci\u00f3n, con posterioridad al examen de fondo habr\u00e1 que pagar nuevamente el  examen de patentabilidad.  Esto se puede hacer siempre y cuando no hayan transcurrido m\u00e1s de 18 meses desde la fecha de publicaci\u00f3n de la solicitud.<\/p>\n<p style=\"text-align: justify;\">Si la Oficina de Patentes colombiana hace una objeci\u00f3n para que se divida una solicitud y el solicitante no lo hace, la Oficina solamente estudiar\u00e1 el primer grupo inventivo que se identifique en la solicitud inicial.<\/p>\n<p style=\"text-align: justify;\">A las solicitudes divisionales adem\u00e1s de la tasa de solicitud habr\u00e1 que pagarles examen de patentabilidad.  Si se presenta la conversi\u00f3n de una solicitud de patente de invenci\u00f3n a modelo de utilidad y esta se hace despu\u00e9s de que ha vencido el plazo del pago de examen de patentabilidad para ese modelo, deber\u00e1 pagarse adem\u00e1s de la tasa de conversi\u00f3n de modalidad la tasa de examen de patentabilidad.<\/p>\n<p style=\"text-align: justify;\">De igual forma funciona si la conversi\u00f3n se hace de modelo de utilidad a patente de invenci\u00f3n.
