REQUIREMENTS TO REQUEST A DIVISIONAL APPLICATION
The New Creations divisions of the Superintendence of Industry and Commerce establishes a series of conditions to request a divisional patent application
The first condition is related to the subject matter of the division. The subject matter must be taken from the original chapter presented with the parental application.
The second condition establishes that the divisional application must be made literal taking into account the numbering of the initial claims chapter and consecutively.
The last one requires that the matter to be divided in the divisional application has not been studied in the parental application.
