COLOMBIA
APPROVAL OF COPYRIGHT AND NEIGHBORING RIGHTS LAW
One of the requirements for Colombia’s access to the Organization for the Economic Co-operation and Development (OECD) was the approval of a law updating the current Copyright and Neighboring Rights regime. The bill was recently approved by Congress and was submitted for presidential approval in order to become enforceable
Among the envisaged updates we may highlight the following: legal provisions regarding control measures were established, IP rights enforcement measures were modified, the protection term for legal entities owning copyrights was extended, the scope of economic author’s rights and neighboring rights was specified, the treatment for use of orphan works was set forth and the regime of limitations and exceptions to copyrights was updated.
