PATENT OFFICE STATES RULES REGARDING AMOUNT OF SUBSTANTIVE EXAMS
The Patent Office issued Resolution No. 3719 of 2016, stating that up to two additional substantive exams can be carried out provided that the deadline for the patentability exam is of less than 18 months counted from the publication date for patents, or less than 9 months from the publication for utility models.
The possibility of conducting two additional exams will take place if applicants respond the patentability exam and:
- Modify the claims.
- Modify the description of the invention.
- Submit new claims.
In this cases, a new payment of official fees for the patentability exam will be necessary.
